This agreement (the “Release”) confirms the terms on which you agree to allow CONVERSE and the CONVERSE Group to use, for the purposes set out below, image(s) featuring you (if over 18) or your child (if under 18, of whom you confirm you are the parent or guardian).

SPECIFIC PURPOSES OF THE IMAGE (“Specified Purposes”)
Any commercial or non-commercial purposes in all and any media including without limitation in CONVERSE’s printed publications, presentations, promotional material, in the advertising of CONVERSE’s goods or services or on CONVERSE’s websites and social media platforms.
WHAT I WILL RECEIVE?
The individual in the photo acknowledges that there will be no payment made to them by CONVERSE for the Image or the rights of CONVERSE to use the Image as detailed below.
CONDITIONS
11 CONVERSE Netherlands B.V. (“CONVERSE”) or another member of the “CONVERSE Group” (meaning CONVERSE Inc., CONVERSE, its subsidiaries, any company or entity to which CONVERSE or any of its subsidiaries licenses rights or provides services to, and/or any company which is, in relation to any such company, its parent undertaking or subsidiary) is sponsoring, producing, directing, organising, running or paying for the Event, in which I wish to take part.
12 I understand and agree that CONVERSE may photograph and/or film me during my participation and attendance at the Event and may use the Image for the Specified Purposes.
13 I warrant that: (i) I do not need to obtain permission from or pay any third party in connection with the rights granted in this Release; (ii) I am entitled to grant the rights set out in this Release; and (iii) CONVERSE does not need to obtain permission from or pay any third party in connection with the rights granted in this Release.
14 I grant CONVERSE exclusive permission to use the Image throughout the world for the Specified Purposes, including permission to publish the Image on the internet, in its original format, edited, or altered in any way that CONVERSE deems appropriate.
15 I do not object to CONVERSE storing copies of the Image for as long as necessary to fulfil the Specified Purposes or to CONVERSE storing my contact details on its database in case it needs to contact me.
16 For the purposes of this Release, the data controller is the CONVERSE entity referenced above in the CONVERSE definition. I agree and acknowledge that by ticking the box below I give my consent, for the purposes of applicable data protection legislation, for CONVERSE to process the personal data provided in relation to the Image or as part of the rights granted in this Release form, including my image and contact details. CONVERSE will process any such personal data in accordance with applicable data protection legislation and the CONVERSE Privacy Policy in force from time to time, which is available at https://www.converse.com/uk/en/privacy-and-cookie-policy/cookie-privacy.html. 17 This Release constitutes the entire agreement between us and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between us, whether written or oral, relating to its subject matter. This Release cannot be altered or modified. Each party agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in this Release.
18 If any wording in this Release is held, in part or in full, to be invalid or unenforceable for any reason, the validity of the remaining clauses of this Release shall not be affected, and they shall continue to be valid and enforceable. The invalid and unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision.
19 This Release and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the jurisdiction of the signatory’s residence.
DATA PROTECTION NOTICE
For the purposes of this Release, the data controller is the CONVERSE entity referenced above. In completing the Image Release Form and allowing CONVERSE to use the Image, you will provide CONVERSE with certain personal data, including your image, contact details and personal details. You understand and acknowledge that by completing the Image Release Form and ticking the box to state that you agree with this Data Protection Notice, you give consent for CONVERSE to process your personal data. CONVERSE processes the personal data to use your image across its platforms, as well as to handle queries and other follow-up matters in relation to the image.
CONVERSE may share your personal data with third parties to process the data on CONVERSE’s behalf. When using third parties to process data, CONVERSE will require the third parties to implement appropriate measures to protect your personal data. CONVERSE may transfer or store the personal data collected and processed as part of the NCX outside of the EEA or Switzerland. When doing so, CONVERSE will ensure that your personal data transferred to these countries receives adequate protection in accordance with data protection rules.
CONVERSE will process your personal data at all times in accordance with applicable data protection legislation. PARENT/GUARDIAN AGREEMENT
THIS COMPLETED AND SIGNED PARENT/GUARDIAN AGREEMENT MUST BE RETURNED TO CONVERSE PERSONNEL AT CHECK-IN AT THE EVENT
We are the parents who have parental authority, or the legal guardians of the Participant and agree that they may take part in the CONVERSE Event. On behalf of the Participant, ourselves, the Participant’s parents or guardians, heirs, estate, insurers, assigns and anyone else who may make any claim for or on behalf of the Participant, we hereby unconditionally:
i. agree to all of the Rules;
ii. agree to cause the Participant to comply with the Rules;
iii. agree to accompany the Participant throughout the Event;
iv. authorise and permit CONVERSE, its agents, and personnel involved in the CONVERSE Event to administer first aid to the Participant, emergency transportation, and any other medical treatment performed by doctors, paramedics, and other medical personnel in the event of any illness, accident or injury to the Participant.
